This is different from all other times where a knee is down with possession so figure it would be good to remember. NOT the case if the holder muffs or fumbles the snap.

Muffs or fumbles the snap after his knees have been off the ground...so muff or fumble while his knee is on the ground can be placed for the kick or he can rise....

Context (part of rule or case): Exception 2: If the holder rises from his knee to catch an errant snap they can immediately return to their knee and hold OR rise again to pass, hand or kick the ball.

SECTION 27 MUFF
A muff is the touching of a loose ball by a player in an unsuccessful attempt to secure possession.

Rule 5-1-3: e. R, if K legally kicks during any scrimmage down and the ball is recovered by R, is in joint possession of opponents, goes out of bounds or becomes dead with no player in possession. (therefore R gets the ball!)

When no player is going to pick up the ball and the ball stops moving you can kill the play. Remember first touching doesn't automatically kill the play.

Question because R1 gave a fair-catch signal the recover by R2 is dead at 1-yard line? Yes 

Also had a fair-catch not been called would it have been a safety when R2 was tackled in the end zone? Momentum can be considered if recovered. If it still from the muff. Then it would be a touchback once the kick breaks the plane of the goal line.

This rule only specifies if a penalty was declined. What if there was no penalty at all? 

If the penalty is declined or there is no penalty we will handle per rule book. A accepted penalty would take precedence over the inadvertent whistle provisions.
